Terms of Service for HeyBene, including the current launch-batch reservation, shipping, and refund terms.
1. Agreement to Terms
Welcome to HeyBene. These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, products, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our Services. We may update these Terms from time to time, and updated terms become effective when posted on this site.
2. Eligibility
You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
3. Account Registration
To access certain features of our Services, you may need to create an account. When you do, you agree to provide accurate information, keep your credentials secure, and notify us promptly if you believe your account has been accessed without permission.
4. Products and Purchases
4.1 Product Information
We strive to display product information accurately, including descriptions, images, launch-state messaging, and pricing. Some pages may describe a current reservation deposit, a future fulfillment step, or an early launch-batch configuration rather than a mature mass-market retail product. The product page and checkout flow shown when you place an order control that order.
4.2 Pricing and Payment
All prices are displayed in the applicable currency and may change without notice until an order is placed. Some launch offers on this site may be structured as a reservation deposit rather than the full final product price. If the amount due today is a reservation deposit, that will be stated on the relevant product page and in checkout. If additional fulfillment confirmation, balance collection, or scheduling is required later, we will communicate that before shipment confirmation is locked.
4.3 Order Acceptance
An order confirmation does not by itself mean that we have accepted the order in all circumstances. We reserve the right to accept, decline, limit, or cancel an order for reasons including product availability, pricing or content errors, payment issues, or suspected fraud.
5. Shipping and Delivery
The current launch-batch reservation flow is intended for U.S. shipping addresses unless a product page states otherwise. We may share estimated timing windows, but shipment dates are not guaranteed and may change as the launch develops. If timing changes after you place a reservation, we will communicate the updated window before shipment confirmation is locked.
Risk of loss and title for delivered products pass to you upon delivery to the carrier or other shipping handoff point, subject to applicable law. We are not responsible for delays caused by carriers or other circumstances outside our reasonable control.
6. Returns and Refunds
Launch-specific return and refund handling depends on the offer shown when you place the order. For the current Bene Tabletop launch batch, reservation deposits may be canceled and refunded before shipment confirmation when requested through support.
- Requests should include the order reference and enough detail for us to review the issue.
- After delivery, damage, defect, or fulfillment issues are reviewed case by case.
- Launch-batch variations disclosed before checkout are not automatically treated as fulfillment defects.
- If a product page or checkout flow states a different launch-specific policy, that launch-specific policy controls that order.
If a refund is approved, it is issued to the original payment method within a reasonable processing window after review. For the current launch, the Returns page and the order-specific checkout flow should be treated as the customer-facing source of truth.
7. Intellectual Property
All content, features, and functionality of our Services - including text, graphics, logos, icons, images, audio, video, software, and overall design - are owned by HeyBene or our licensors and are protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use our content without prior written permission.
8. User Conduct
You agree not to:
- Use the Services for any unlawful purpose or in violation of applicable law.
- Interfere with or disrupt the Services or servers connected to the Services.
- Attempt to gain unauthorized access to any part of the Services.
- Use automated tools to scrape or misuse the Services without permission.
- Transmit malware or other harmful code.
- Impersonate any person or entity or misrepresent your affiliation.
9. Disclaimer of Warranties
THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEYBENE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICES.
11. Indemnification
You agree to indemnify, defend, and hold harmless HeyBene and its officers, directors, employees, agents, and affiliates from and against claims, liabilities, damages, losses, and expenses arising out of or connected with your access to or use of the Services or your violation of these Terms.
12. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the Services shall be resolved exclusively in the state or federal courts located in San Francisco, California, unless applicable law requires otherwise.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
